LIBRARY MEMBERSHIP & BORROWING AGREEMENT
This Library Membership & Borrowing Agreement (“Library Agreement”) establishes the terms and conditions for participating in the Cache Valley Babywearing Library (“Library”).
By joining the Library, borrowing or renting Library property, or otherwise accepting this Agreement through the Platform, you acknowledge that you have read, understood, and agree to comply with these terms.
This Library Agreement is specifically for the lending library. Your use of the Platform is also subject to the Platform Service Agreement and applicable Privacy Policy.
Where this Library Agreement establishes rules specific to Cache Valley Babywearing Library, those Library-specific rules apply to your participation in this Library.

1. ABOUT THE LIBRARY
Cache Valley Babywearing Library is a lending library that makes baby carriers and related equipment available to members for educational, recreational, and personal use.
Library property remains the property of the Library or the applicable owner and is provided to members on a temporary lending or rental basis.
A Library membership does not transfer ownership of any carrier or other Library property to the member.

2. MEMBERSHIP TYPES
The Library may offer different membership types. Membership types, prices, benefits, and applicable terms will be displayed at the time of enrollment.
The Library may change membership offerings for future memberships. Changes will not retroactively alter the terms of an existing membership except as permitted by this Agreement and applicable law.

3. MEMBERSHIP FEES
The applicable membership fee will be disclosed before you enroll.

Membership fees generally provide access to the Library’s lending services during the applicable membership period but do not guarantee the availability of any particular carrier.
4. BORROWING PERIOD
Unless otherwise stated at the time of checkout:
- The standard loan period is 14 days from the date of pickup.
- A carrier may be renewed for additional 14-day periods upon request when permitted by the Library.
Renewals are subject to availability and may not be available when another member has requested the carrier. - A carrier may generally be borrowed for a maximum of two consecutive loan periods before it must be returned for Library maintenance and inspection.
- The Library may establish different loan periods for particular items or circumstances.
- The due date displayed by the Platform or otherwise communicated by the Library is the controlling due date for your loan.
5. PICKUP AND RETURN
Carriers must be picked up and returned by arrangement with Library staff or volunteers.
Members are responsible for ensuring that borrowed property is successfully returned to the Library by the applicable due date.
A member remains responsible for an item until the Library receives and accepts the return.
For shipped items, the applicable shipping and return instructions provided by the Library will determine when responsibility transfers back to the Library.
If a carrier cannot be returned on time, you should contact the Library as soon as possible.

6. CARE AND MAINTENANCE
Members agree to take reasonable care of all Library property.

- Only spot clean with water, and inform a Library administrator, staff, or volunteer immediately if it needs further cleaning.
- Store the carrier in a clean, dry environment.
- Protect the carrier from unnecessary exposure to dirt, moisture, smoke, animals, and other conditions that may damage or contaminate it.
- Not alter, modify, repair, dye, decorate, or otherwise change the carrier.
- Not remove labels, tags, safety information, or identifying markings.
- Not use products or cleaning methods that could damage the carrier.
If you are uncertain how to care for a carrier, contact the Library. Do not attempt to clean or repair it.
7. SMOKE, ODORS, AND CONTAMINATION
Members must not bring Library carriers into environments where smoking or other activities that may expose the carrier to smoke or persistent odors occur.
Members must take reasonable precautions to prevent Library property from being exposed to:

- Marijuana smoke
- Other smoke
- Strong or persistent odors
- Animal waste
- Excessive animal hair
- Other substances that may make the carrier unsuitable for lending
If a carrier is returned with a persistent odor or contamination that cannot reasonably be removed through the Library’s normal cleaning procedures, the member may be responsible for the applicable damage or replacement fee.
8. ANIMALS
Library carriers are intended for human use.

Members should also minimize contact between Library carriers and household animals during the loan period.
9. ALLERGENS
The Library cleans and maintains carriers between uses and makes reasonable efforts to reduce exposure to common allergens.
However, because Library carriers are previously used textile products, the Library cannot guarantee that a carrier is completely free of:

- Dander
- Dust
- Fragrances
- Other allergens or environmental substances
Members with significant allergies or sensitivities are responsible for determining whether use of a particular carrier is appropriate for their circumstances.
Members may contact the Library with questions about a carrier’s known history or available cleaning information.

10. INSPECTION AND SAFETY
Members must inspect a carrier before each use.
Do not use a carrier if you observe a condition that appears unsafe or may affect the carrier’s structural integrity.

- Holes
- Broken stitching
- Damaged or loose hardware
- Missing components

Members must also notify the Library if the carrier is involved in an accident, fall, or other incident that could potentially affect its condition.
The Library may remove a carrier from circulation at any time for inspection, maintenance, repair, replacement, or other safety-related reasons.

11. RECALLS AND SAFETY INFORMATION
Members agree to promptly notify the Library if they become aware of a safety recall or other manufacturer-issued safety notice affecting a carrier they currently have on loan.
The Library may contact members regarding recalls, safety concerns, or other issues affecting borrowed property.

12. APPROPRIATE USE
Library property may only be used for its intended purpose.

- Not sell, transfer, or otherwise give the carrier to another person.

A member may not permit another person to take possession of Library property without prior authorization from the Library.
13. LATE RETURNS
A carrier is considered late when it has not been returned by the applicable due date and no approved extension has been granted.
The Library charges a late fee of $5 per day, up to a maximum of $35 per loan.
Late fees begin accruing according to the Library’s applicable due-date policy.
The Library may waive or adjust a late fee at its discretion when circumstances warrant.

14. LOST, UNRETURNED, OR SEVERELY DAMAGED PROPERTY
A member may be responsible for the replacement cost of Library property when the property:
- Is lost
- Is not returned
- Is not returned within the applicable period
- Is damaged beyond reasonable repair
- Is improperly washed or cleaned and cannot reasonably be restored
- Is exposed to smoke or contamination that cannot reasonably be removed
- Is otherwise damaged in a manner requiring replacement
Unless otherwise stated for a particular item, a carrier that remains unreturned 7 days after its due date will be considered lost and subject to a replacement fee in addition to late fees.
The replacement fee may be based on the reasonable cost of replacing the item with the same or a substantially equivalent item.
The Library may consider the age, availability, condition, and replacement cost of the original item when determining the appropriate charge.

15. DAMAGE FEES
Not all damage requires complete replacement.
When an item can reasonably be restored or repaired without impairing the safety of the item, the Library may assess a damage fee rather than a full replacement fee.

16. FEES ARE DUE
Applicable late, damage, replacement, rental, shipping, membership, and other authorized fees become due according to the terms applicable to the transaction.
The Library may notify you of a newly assessed fee through the Platform or another communication method associated with your account.
Outstanding balances may affect your ability to make additional checkouts or renewals. Generally, additional carriers are not able to be checked out when there is a balance on the account.

17. PAYMENT AUTHORIZATION
By accepting this Agreement and providing or authorizing a payment method through the Platform, you authorize the Library and/or Platform payment system to process charges properly assessed under this Agreement.

Some charges, including late, damage, and replacement fees, may be assessed after the original checkout or rental transaction based on the condition or return status of Library property.
The Library will not intentionally use this authorization to charge amounts unrelated to Library services or obligations established by this Agreement.

18. INDIVIDUAL RENTALS
The Library may offer individual carrier rentals to individuals who do not maintain a Library membership.
Rental fees, rental periods, deposits, shipping charges, and applicable return requirements will be disclosed before the rental is completed.
Individual rentals remain subject to the care, safety, return, damage, replacement, and other requirements in this Agreement unless the rental terms expressly state otherwise.

19. SHIPPING
The Library may offer shipping for eligible carriers.

The Library is not responsible for delays caused by shipping carriers or circumstances outside the Library’s reasonable control.
20. LIBRARY COMMUNICATION
Members must maintain accurate contact information in their Platform account.

21. MEMBER COMMUNICATION AND CONDUCT
Members agree to communicate respectfully with Library staff, volunteers, educators, and other members.
Members should respond to reasonable Library communications concerning active loans, overdue items, safety concerns, or account issues.
Harassment, threats, abusive behavior, intentional disruption, or other inappropriate conduct may result in suspension or termination of Library privileges.

22. MEMBERSHIP SUSPENSION OR TERMINATION
The Library may suspend or terminate a member’s borrowing privileges when reasonably necessary, including when a member:
- Fails to return Library property
- Has an outstanding balance
- Repeatedly returns items late
- Damages Library property through misuse or failure to follow care instructions
- Violates this Agreement
- Provides materially false information
- Engages in abusive or threatening behavior
- Creates a safety concern
- Attempts to evade Library fees or restrictions
Termination of membership does not eliminate financial obligations incurred before termination, nor does it entitle the member to a refund.
23. ACCOUNT CLOSURE AND OUTSTANDING LIBRARY OBLIGATIONS
If you request closure of your Platform account while you have an active Library loan, outstanding Library balance, or other unresolved Library obligation, you may be required to resolve that obligation before account closure.
If you have Library property checked out, you must return the property before your Platform account and Library membership can be fully closed.

24. LIBRARY PROPERTY REMAINS LIBRARY PROPERTY
All carriers and other physical property provided through the Library remain the property of the Library or their respective owner.

25. LIBRARY RESPONSIBILITY FOR PROPERTY
The Library is responsible for maintaining its own inventory and establishing reasonable procedures for inspection, cleaning, maintenance, and removal of unsafe property from circulation.
The Library does not guarantee that every carrier is appropriate for every caregiver or child.
While the Library makes reasonable efforts to inspect and maintain its inventory, carriers are previously used items and may have ordinary wear associated with their age and use.

26. BABYWEARING SAFETY
Babywearing involves inherent risks, including falls, positional asphyxia, suffocation, overheating, and other potential injuries.
Members are responsible for learning and following appropriate babywearing safety practices and manufacturer instructions.
The Library provides carriers and may provide educational information or assistance, but educational assistance does not replace the member’s responsibility to use the carrier safely.
Members are responsible for determining whether a particular carrier, carrying position, or technique is appropriate for their circumstances.
If a member has questions about safe use of a particular carrier, they should seek appropriate instruction before using it.

The Library may provide demonstrations, educational materials, or assistance with carrier selection and use.
Such assistance is educational in nature and does not guarantee that a member will use a carrier correctly or that a particular carrier is appropriate for the member’s circumstances.

28. REFUNDS AND FEE DISPUTES
Membership and rental fees are subject to the refund policy presented at the time of purchase.
If you believe a Library charge was assessed incorrectly, contact the Library promptly and provide information supporting your concern.

29. CHANGES TO LIBRARY POLICIES
The Library may update its policies from time to time.
Material changes to this Agreement will be communicated as required by applicable law.
A new agreement may require affirmative acceptance before a member may continue borrowing.
Changes to individual fee amounts or membership offerings will be communicated before they apply to a new transaction or renewal, as required by applicable law.

30. ACKNOWLEDGEMENT
By accepting this Agreement, I acknowledge that:
- I have read and understand the Library Membership & Borrowing Agreement.
- I agree to follow all Library borrowing, care, safety, and return requirements.
- I understand that Library property belongs to the Library or its respective owner.
- I understand that I am responsible for Library property while it is in my possession.
- I understand the Library’s late-fee, damage-fee, and replacement-fee policies.
- I authorize applicable charges as described in this Agreement.
- I understand that some charges may be assessed after checkout based on late return, loss, damage, or other circumstances.
- I understand that I must promptly report damage, defects, accidents, recalls, or safety concerns.
- I understand that I am responsible for following manufacturer instructions and using Library property safely.
- I understand that Library property may contain allergens or other substances despite reasonable cleaning efforts.
- I understand that membership or borrowing privileges may be suspended or terminated for violations of this Agreement.
- I understand that account closure does not eliminate outstanding obligations to return Library property or pay properly incurred fees.
